Whiplash: Symptoms and Claims

Whiplash is a neck pain commonly associated with car accidents (especially when a car is rear-ended). With whiplash, the tendons, muscles and ligaments of your neck are strained beyond what the neck is used to. Whiplash injuries can also occur in falls, assault, and sports.

Whiplash symptoms can include neck, shoulder and back pain, pins and needles in the arms, and headaches. Sometimes symptoms take days to manifest themselves.

Although many sufferers of whiplash experience pain for only a few days, in some cases neck and head movement can be restricted severely, and pain can be persistent.

In car accidents, whiplash can be caused even in cars travelling as slow as 15 MPH, but the speed of the cars involved is a big factor in the prevalence and severity of the whiplash injury. Whiplash is also influenced by the size of the vehicles involved, with passengers of smaller cars more likely to suffer from whiplash.

Headrests, and use of a seatbelt, will generally lessen the likelihood of a whiplash injury in the case of the rear-ending of a car.

If you suffer a whiplash injury as a result of a car accident through someone else's fault, you may be entitled to recover your losses from the other party or from their insurance company. These losses include:

  • Compensation for your injury
  • Any medical expenses incurred
  • Loss of earnings suffered
  • Compensation for damage to your vehicle arising from the accident
  • Any other expenses incurred
